Lawsuits Filed by Charitable Organizations Against Trump Administration Regarding Financing for Head Start Initiatives
In a series of legal actions, states, nonprofits, and parent groups are taking a stand against the Trump administration's recent directive redefining Head Start as a "Federal Public Benefit." This move aims to restrict access to the program for undocumented immigrants, marking a significant policy shift that contradicts decades of precedent under the 1996 welfare reform law.
The lawsuit, filed in April 2025 by 20 states and the District of Columbia, led by New York's Attorney General, argues that this change is illegal, was implemented without proper rulemaking procedures, and threatens to close programs serving low-income children and families, causing chaos and risking vital services.
In response to the lawsuit, four federal agencies—Departments of Education, Health and Human Services, Justice, and Labor—agreed to temporarily pause enforcement of the new immigration status verification policy through September 3, 2025, in the states where the lawsuit was filed. This pause covers Head Start and multiple other services affected by the policy.
The American Civil Liberties Union (ACLU) is among the nonprofits actively involved in litigation seeking to block the administration's efforts to dismantle or restrict Head Start services. The ACLU has filed a lawsuit challenging cuts to the Office of Head Start and staffing reductions, and is seeking to amend that complaint to include the July immigration restrictions.
The recent directive has led to operational challenges for Head Start providers, as no federal guidance has been issued on how to implement the new rules. The ACLU is also arguing for a Preliminary Injunction against existing cuts and rollbacks on current Head Start program operations. If the judge grants the Temporary Restraining Order (TRO), it would give the ACLU 14 days before the policy could resume for the U.S Government.
The U.S. District Court in Seattle held a hearing on motions for a preliminary injunction and temporary restraining order. The groups suing include the ACLU, ACLU of Washington, ACLU of Illinois, Impact Fund, Parent Voices Oakland, Family Forward Oregon, and Head Start associations of Washington state, Illinois, Pennsylvania, and Wisconsin.
The administration's actions have reportedly led to nearly $1 billion less in federal funding compared to 2024, resulting in preschool classroom closures for low-income children across the U.S. Sen. Patty Murray has accused the Trump administration of delaying funds appropriated by Congress for the Head Start program.
In the midst of these challenges, Head Start continues to provide comprehensive high-quality preschool, family support, and health services to children aged 0-5. In Washington state alone, about 15,000 children use the Head Start program, with a majority living in poverty and about 15% experiencing homelessness.
The lawsuit remains active with partial enforcement pauses, and plaintiffs are pursuing both injunction relief and broader declarations that the administration’s sweeping policy changes targeting Head Start are unlawful. The case is ongoing, with the judge yet to make a decision on the filings.
